Rentals: Following payment of the Deposit above, the Hirer shall make weekly Rentals of £72.00 inclusive of VAT comprising of a rental charge of £72.00 inclusive of VAT. The weekly Rentals will be payable starting on the agreed date and will continue weekly thereafter on the same day in each subsequent week or on the next business day if the usual payment date falls on a weekend or a bank holiday. Weekly Courier Cover: The Hirer will also make a weekly payment of E42.00 inclusive of VAT in relation to weekly courier cover provided by Revisecatch Ltd This amount is payable to Revisecatch Ltd on the same day and at the same frequency as the Rentals. Duration of Rental Period: The rental period is for a minimum period of 1 week(s) commencing on the date the Vehicle is collected by the Hirer and is continuing until the agreement is terminated in accordance with clause 11 of the terms. Termination of the agreement: If the Hirer terminates the agreement before the end of the minimum period set out above, the Hirer will be required to make a payment to Revisecatch Ltd being an amount equal to the total amount of any unpaid Rentals due under this agreement for the minimum Rental Period set out above, together with any other sums which have become payable under the agreement. NextVEHICLE RENTAL AGREEMENT - TERMS AND CONDITIONS Before you rent a vehicle from Revisecatch Ltd we want to help you to understand the main elements of the Rental Agreement you are about to sign. We are therefore going to outline below a summary of the main terms of the agreement. Do not sign this agreement unless you understand its terms and agree to be bound by them. Feel free to ask as many questions as you wish until you have understood the terms of the agreement fully. You can also contact our Driver Contact Centre by telephone at any time on 02030192640 1.COLLECTION AND RETURN OF VEHICLES 1) All vehicles must be collected from the Revisecatch Ltd premises at Unit 2, Gateway Trading Estate, Hythe Road, London, NW10 6RJ and returned there at the end of the hire. There will be a charge made if vehicles have to be collected during or at the end of the hire to reflect our reasonable costs in collecting the vehicles from the Hirer. 2) A member of staff will explain the controls and instruments of the vehicle as well as the maintenance checks for which the hirer will be responsible whilst the vehicle is in his/her possession. A leaflet on maintenance checks is available. 3) Any damage resulting from misuse, abuse or failure to carry out these checks will be charged to the hirer. Examples would include: • Buckling wheels through kerbing. • Ruining tyres through driving having over or under inflated tyres and so causing damage to said tyres. • Damaging the engine or gearbox through failure to check oil and water regularly. • Damaging brake disks by not checking brake linings regularly. • Damage through continuing to use damaged vehicles. Please note: If the hirer is unable to carry out any checks on the vehicle, then they may request a technician from the service facility to do so on their behalf. 4) Before the hirer takes the vehicle any defect will be noted and agreed and the hirer will sign his/her acceptance of the vehicle in the condition described on the accompanying vehicle check sheet. A copy of the vehicle check sheet is available for the hirer to keep upon request (a copy is enclosed). A similar inspection will take place on return of the vehicle at the end of the hire. PreviousNext2. TAKING CARE OF THE VEHICLE You are responsible for taking good care of the vehicle during the rental period. For example: You must always set the alarm (if installed) and lock the vehicle when leaving it unattended. For motorcycle contractors the steering lock is not adequate theft prevention alone, you must provide a second lock such as a disk lock or good quality chain. You must clean the vehicle, inside and out, at least once a week and more if necessary if required. (Spot checks are carried out on vehicles and if the vehicle is found not to be clean and presentable the company will clean the vehicle and charge the hirer for that service). If you have the vehicle on a long term hire it will need to come to our service centre for periodic maintenance work. The vehicle must be presented clean before this work can be undertaken. If it is not presented clean then you will be charged to have it cleaned. If you are leaving the vehicle for a number of days but returning to continue the hire afterwards the vehicle must be clean when left here. Again, if you do not clean the vehicle you will be charged to have it cleaned. If the hirer should have any mechanical problems these should be reported immediately to the Driver Contact Centre on 0203 019 2640. 3. CHARGES The hire charges are set out on the front page of the agreement. The hirer will be required to pay a deposit on collection of the vehicle on commencement of the hire. The deposit may be refundable to the hirer when the vehicle is returned. The hirer must pay Revisecatch Ltd the full amount of all charges as specified on the Rental Agreement and all charges will be inclusive of VAT at the current rate (currently 20%). 4. ACCIDENT DAMAGE OR LOSS 1) In the event of an accident, once the safety and wellbeing of those involved is in hand, it is imperative to gain witnesses names and addresses. The witnesses independent assessment of what had taken place may enable liability for the cost of the accident to be passed to a third party should they be at fault. 2) Any damage will be charged to the hirer up to a maximum of £500 for each and every incident. There is no opportunity to recover costs and the hirer's £500 excess unless there are independent witnesses who can support any claim made by the hirer. If the hirer has an accident and their deposit is lost, the hirer will be required to start paying a new deposit of the same value. The company reserves the right to withhold monies owed to the driver where the driver does not have sufficient deposits held against the accidents which have occurred. Deposits and monies that are withheld due to accidents will not be released until the liability for the accident has been settled by the two insurance companies and only then if fault is found with the third party. 3 )The accident must be reported to the Workshop on 020 3019 2640 within 24hours of the incident and you must attend the workshop within 72 hours to complete an accident form. 4) If the vehicle is damaged, lost or stolen the hirer will be liable for a maximum of £500 for each and every incident. This limit of liability will be void if the damage or loss is due to gross negligence. For example: Note this is not an exhaustive list. • Not locking the vehicle when left unattended. • Driving under the influence of drink or drugs .Random tests will be carried out and also if the driver is suspected to be under the influence of drugs or alcohol. • Driver abuse. 5) The first £500 of loss or damage for which you are liable (in each incident) also applies to any 3rd party involved in any accident. For example: If the hirer damages another vehicle in an accident, the hirer may be liable for the cost of repairs up to a maximum of £500. The hirer may ultimately recover that £500 if the insurers or the courts decide that the hirer was not at fault and are able to make a third party liable for the incident. PreviousNext5. SAFETY ON THE ROAD It is preferable that the hirer takes a cautious and careful approach to driving and thereby avoids accidents. A driving style, which is considerate and cautious, will not only avoid accidents but also dramatically improve fuel economy. If the hirer's rental agreement is one under which liability for a proportion of the cost of the parts used on the vehicle, again a smooth and cautious diving style will also dramatically extend the life of many components. 6. PARKING FINES AND OTHER TRAFFIC VIOLATIONS The hirer is liable and must pay any fines (such as parking penalties and speeding fines) incurred whilst the vehicle is rented to them. If Revisecatch Ltd has to pay any such fines they will be charged onto the hirer and an administration charge will also be levied. It is worth noting that once the owner of the vehicle is notified of an outstanding fine it has usually been increased to cover the costs of the issuing authorities administration costs. Under this agreement you have agreed to be responsible for any congestion charges (if applicable) at the applicable rate which you incur whilst using this vehicle, if you do NOT complete your agreed shift pattern and hours of work. If the hours and shift pattern are adhered to, the company will pay these charges for you. If however you should fail to pay the congestion charge within the prescribed timescale you will also be liable for any penalty fines issued as a result of the failure to pay. Please note that at the end of the hire, £130.00 of your deposit will be held for one calendar month from the date of vehicle return. (This is for non- transferable parking and traffic fines that may arrive after return of the vehicle.) It will only then be processed in the usual way and released on the following Friday. The hirer acknowledges that during the rental period of this agreement, in addition to the charges noted above, the hirer shall be liable as the owner of the vehicle let in respect of: (a) Any fixed penalty offence committed in respect of that vehicle under Schedule 6 of the Road Traffic Offenders Act 1991, (or as amended, replaced or revised by subsequent legislation or orders). (b) Any excess parking charges, which may be incurred in respect of that vehicle and pursuance of an order under section 45 andor section 46 of the Road Traffic Regulations Act 1984, (or as amended, replaced or revised by subsequent legislation or orders). (c) Any charges made by Customs and Excise as a result of seizure of the vehicle by them together with a loss of income charge while the vehicle is unavailable for rental. 7. PERSONAL PROPERTY Insurance cover does not extend to cover personal property. 8. UNAUTHORISED DRIVERS The hirer alone is authorised to drive the vehicle. If anyone else drives the vehicle they will be uninsured and the hirer will be committing an offence. 9. DRIVING OUTSIDE THE U.K. The hirer is specifically forbidden from driving the hire vehicle outside the U.K. If the hirer should do so the Rental Agreement would have been breached and the insurance invalid. PreviousNext10. SMOKING IN THE VEHICLE The hirer is not permitted to smoke in the vehicle. England has become smoke free from 01st July 2007. The new law has been introduced to protect employees and the public from the harmful effects of second-hand smoke. The new law means that it is now against the law to smoke in any company vehicle. If you are caught smoking in a company vehicle you will be subject to a fixed penalty fine of £50.00. Please note, anyone found peeling stickers off any company vehicles will be charged £10 per sticker. Failure to comply with the new law will be a criminal offence. This provision is not applicable if the vehicle is a motorcycle. 11. TERMINATION At the end of the minimum Rental Period, this agreement will automatically continue. Either party may terminate the agreement following on from the end of the minimum Rental Period, by giving the other party at least one business day's notice. The hire will then terminate on the last day of the notice period and the hirer must immediately return the Vehicle to the point of collection.The hirer will be responsible for the vehicle and any Rentals due under the agreement until the vehicle is returned, together with any unpaid Rentals, charges and other sums due under the agreement. 12. COMPLAINTS If you have a complaint, you should contact the Driver Contact Centre on 020 3019 2640 and select the appropriate option. Alternatively, you can write to the Fleet Manager at Revisecatch Ltd of Unit 3, Gateway Trading Estate, Hythe Road, London, NW10 6RJ. PreviousNextKey Information The following charges may be payable by the Hirer to Revisecatch Ltd under the agreement. - an administrative charge if the Vehicle(s) has to be collected during or at the end of the agreement term (see clause 1 of the terms). - the costs incurred by Revisecatch Ltd in making good any damage caused to the Vehicle(s) as a result of any misuse, abuse or failure to carry out adequate maintenance checks to the Vehicle(s) during the Rental Period (see clause 1 of the terms). - the costs incurred by Revisecatch Ltd in cleaning the Vehicle(s) if the Hirer fails to keep the Vehicle(s) clean (see clause 2 of the terms). - the cost of any damage caused to the Vehicle(s) and any subsequent repairs as a result of an accident, any damage or loss caused up to a maximum of £500 for each and every incident unless the damage or loss is due to the gross negligence of the Hirer in which case there will be no limit on the Hirer's liability under the terms (see clause 3 and 4 of the terms). - if the Vehicle(s) is lost or stolen, a charge of up to a maximum if £500 for each and every incident unless the loss is due to the gross negligence of the Hirer in which case there will be no limit on the Hirer's liability under the terms (see clause 4 of the terms). - the cost of any damage caused to another Vehicle(s) as a result of the Hirer's use of the Vehicle(s) to the extent that any amounts are charged to Revisecatch Ltd up to a maximum of £500 unless the damage was caused by the Hirer's gross negligence (see clause 4 of the terms). - the cost of any fines or other costs (such as parking penalties, speeding fines and/or congestion charges) incurred in relation to the Vehicle(s) during the Rental Period and/or whilst it is in possession of the Hirer, together with an administrative charge of £[10] + VAT(see clause 6 of the terms). - a fixed penalty fine of £50 if the Hirer is found to be smoking in the Vehicle(s) (see clause 10 of the terms). - a charge of £10 +VAT per sticker in the event that any stickers are removed from the Vehicle(s) either partially or in full during the Rental Period (see clause 10 of the terms). This Agreement is not cancellable under the Consumer Credit Act 1974. MISSING PAYMENTS Missing payments could have severe consequences and may make obtaining credit more difficult. IMPORTANT - READ THIS CAREFULLY TO FIND OUT ABOUT YOUR RIGHTS The Consumer Credit Act 1974 covers this agreement and lays down certain requirements for your protection which should have been complied with when this agreement was made. If they were not, the owner cannot enforce this agreement against you without getting a court order. With this in mind you are required to carry out the following checks as a minimum: - Condition of Vehicle Bodywork. - Condition of Windscreen Wiper Blades. - Cleanliness of Windscreen, Windows, Mirrors, Lights and Number Plates. - Condition of Tyres,Tyre Pressures and Tyre Wear. - Availability of Spare Wheel and Jack. - Engine Oil. - Coolant Level. - Windscreen Washer Bottle. - Any Leaks from the vehicle. - Condition and function of Seat Belts. - Head Restraint adjustment. - Mirror adjustment. - First Aid Kit (where provided). - Fire Extinguisher (where provided). - Torch (where provided). - Warning Triangle (where provided). - Vehicle Handbook. Functions - All Lights - Horn - Washer and wipers - Brakes - Fuel By signing this declaration, you are confirming that when you log on with your controller or accept your first job of the day, you have carried out the checks outlined above. We also expect you, having leased your vehicle in good condition, to ensure that it remains this way, and that if there are any issues with the vehicle, these are reported in the first instance so that we can make a decision on the best course of action. You must not knowingly drive or ride your vehicle if it is defective without having first consulted with Revisecatch Workshop via your controller. Hopefully all of the above is clear. So just to clarify, the vehicle will have to have been cleaned inside and out before presenting yourself with the vehicle at the workshop. There are no facilities for cleaning the vehicle at the workshop a dirty vehicle will incur a cleaning fee of £50 +VAT, this includes vehicles returned for a period of 7 days or more.
